1. Summary

Introduction

We are GoCompare.com Limited, trading as weflip (referred to in these terms and conditions as "weflip").

This document sets out the terms and conditions which you and weflip have agreed to be legally bound by in connection with the Services.

It is extremely important that you read these terms and conditions and weflip's privacy policy carefully. You must not use the Services if you do not agree to these terms and conditions or the terms of weflip's privacy policy.

Definitions

In these terms and conditions, the following words shall have the following meanings:

  • "Comparison Service" means the independent comparison service provided to you by weflip, which service shall allow you to manually compare and complete your first flip to products or services provided by third parties;
  • "Flipping Service" means the independent automated-switching service provided by weflip for and on your behalf, which service may from time to time automatically compare and flip products or services provided to you by third parties after you complete your first flip via the Comparison Service;
  • "Services" means the Comparison Service and/or the Flipping Service; and
  • "you" and "your" means any user of the Services.

2. Changes to these terms and conditions

weflip reserves the right to amend or update these terms and conditions from time to time. Any modified version of these terms and conditions will be published on this webpage and notified to you. If you do not agree to any modified terms and conditions then you must immediately cease all use of the Services since your continued use of the Services after modified terms and conditions have been published and notified to you will constitute your acceptance of those modified terms and conditions.

4. The Comparison Service

Finding a new provider and/or new products or services for your first flip

When using the Comparison Service in order to find a new provider and/or new products or services for your first flip you will be asked to provide or confirm certain information. This information is used to provide you with an estimate of the amount you may save by flipping to a new provider and/or new products or services.

weflip shall be under no obligation to verify the accuracy or reliability of any information which you have provided or which has been confirmed as accurate by you and it is your responsibility to ensure that such information is correct. Providing or relying on inaccurate information may result in you being provided with inaccurate projected savings and/or flipping to a provider and/or new products or services which are not suitable for your needs.

Please note that if you are unable to provide certain information (such as, in the case of weflip’s energy comparison service, your actual energy usage), weflip may be able to estimate such information (for example, based on other information provided by you). weflip does not warrant or represent that such estimate will be accurate and hence providing information which you know to be accurate is therefore recommended.

Before you apply for your first flip

Before you submit your first application via the Comparison Service, it is extremely important that you read and familiarise yourself with your chosen provider's terms and conditions and any specific terms and conditions applicable to the new products or services you have chosen.

Your chosen provider's terms and conditions and any specific terms and conditions applicable to the new products or services you have chosen will govern both your relationship with your chosen provider and the basis on which your chosen provider will provide new products or services to you. It is your responsibility to satisfy yourself that a product or service is both suitable for your needs and available on terms which you are willing to agree.

You should also note that some providers may carry out hard credit searches once a flip request is made by you. Hard credit searches may adversely affect your credit rating and will be visible to other parties who check your credit file from time to time.

After you apply for your first flip

You may only be able to cancel your first flip within the fourteen (14) day cooling-off period after a provider has accepted your flip request via the Comparison Service. You can exercise your right to cancel by contacting weflip or your chosen provider directly. If you cancel your flip request by contacting your provider directly, you should let weflip know so that all information which weflip holds about your current provider is accurate and up-to-date. Details of how you may contact your chosen provider should be available on that provider's own website or in that provider’s own terms and conditions.

Some flip requests may take longer to action than others. For example, in the case of energy products or services it frequently takes between seventeen (17) and twenty-one (21) days for a flip to become effective but the process can take longer. You should be notified when your flip becomes effective by your chosen provider. It is important to note that there may be circumstances where a current provider delays or prevents a flip from taking place, such as where it suspects fraudulent activity, if a customer is in debt or if a customer has a bill outstanding that has been unpaid for twenty-eight (28) days or more. In the case of energy products or services, if a customer is paying off debts of less than £500.00 for each of gas and electricity, it is also possible that those debts will be assigned from an existing provider to a replacement provider when the flip becomes effective.

5. The Flipping service

Nothing within these terms and conditions shall oblige weflip to provide the Flipping Service to you and nothing within these terms and conditions shall oblige you to subscribe to the Flipping Service. However, if you do subscribe to the Flipping Service you should not seek independently to switch your provider after you have completed your first flip via the Comparison Service and whilst weflip is providing the Flipping Service to you. If you do this, it may result in you flipping to a replacement provider and/or product or service which is not suitable for your needs. You may terminate or suspend provision by weflip of the Flipping Service at any time and without obligation by contacting us.

It may be necessary from time to time for weflip to seek confirmation that you are happy to continue to take part in the Flipping Service and/or that the information you have previously provided to weflip remains accurate and up-to-date. weflip may be unable to provide the Flipping Service in the event that you do not respond in a timely manner to any request for such confirmation and weflip reserves the right to immediately cease providing the Flipping Service without notice to you in these circumstances.

Acting as your agent

By consenting to weflip providing the Flipping Service, you appoint weflip to act as your agent strictly in connection with the provision of the Flipping Service. As your agent in connection with the provision of the Flipping Service, weflip will act for and on your behalf including by: accessing information held about you by third parties; terminating your existing legal relationships with providers of products or services; and/or negotiating and concluding new legal obligations between you and providers of new products or services.

It is important to note that as part of the Flipping Service weflip will not manage your contract with your new provider, even if that provider is a provider to whom weflip has introduced you. This means that you shall remain solely responsible for complying with the terms of your contract; receiving and paying bills; providing information required by your new provider; and/or other general customer service issues, complaints or queries.

Finding a replacement provider and/or products or services for you

When providing the Flipping Service to you, weflip will exercise reasonable skill and care and will act only on information available to it at the time. In particular, this information may include information which you have provided or confirmed regarding your needs and preferences. weflip shall be under no obligation to verify the accuracy or reliability of any information which has been provided by you or already confirmed by you and it is your responsibility to ensure that such information is at all times correct.

weflip reserves absolute and sole discretion to determine if a flip is activated. In deciding if a flip is activated, weflip will take account of your known needs and preferences and weflip may also take account of other factors such as a provider's customer ratings, stability, capacity and track record. weflip cannot and does not warrant or represent that the cheapest available product will be chosen for you at any given time.

Once a replacement provider and/or products or services have been found for you

weflip will notify you in writing once the process of flipping you to a replacement provider and/or product or service has commenced.

Once weflip has commenced the process of flipping your existing provider and/or product or service on your behalf, it is extremely important that you read and familiarise yourself with the replacement provider’s terms and conditions and any specific terms and conditions applicable to the replacement product or service chosen for you. It is your responsibility to satisfy yourself that a replacement product or service is both suitable for your needs and available on terms which you are willing to agree.

In particular, you should also note that some providers may carry out hard credit searches once a flip request is made on your behalf. Hard credit searches may adversely affect your credit rating and will be visible to other parties who check your credit file from time to time.

Cancelling a flip requested on your behalf

After weflip has requested a flip on your behalf via the Flipping Service, you may only be able to cancel the flip within the fourteen (14) day cooling-off period after a provider has accepted your flip request via the Flipping Service. 6. How weflip is paid

The Services are provided to you by weflip free of charge. Instead, weflip generates revenue from the Services by charging your new provider a commission. You may contact us for further information regarding the commission we receive in connection with the Flipping Service.

7. General

The Services are intended for use only by customers who are aged 18 or over and located in England, Wales and Scotland. weflip does not warrant or represent that the Services will be available or appropriate for use outside of England, Wales or Scotland and any use of the Services by you from other locations will be at your sole risk.

8. Your Account

In order to initiate and track the progress of a flip request you will need to create an account by providing weflip with certain specified information and creating log-in credentials. Your log-in credentials are personal and should not be shared by you. You will be solely responsible for all activity that occurs on your account and you should immediately inform weflip in writing upon becoming aware of any breach of security or other unauthorised use of your account.

9. Intellectual Property

The trade marks, copyright, database rights and all other intellectual property rights in the Services, the weflip website and the content, information, material and/or data published on the weflip website shall belong to weflip or its licensors. Except as expressly provided herein, nothing within these terms and conditions shall operate to convey or transfer any title, right or interest in such intellectual property rights.

Any content, information, material and/or data which you make publicly available on or through the weflip website will belong to you but you hereby grant weflip a perpetual, irrevocable, transferable, worldwide, royalty free and unlimited licence to use such content, information, material and/or data for any purpose in connection with the operation of the weflip website and the provision of the Services.

10. General Restrictions on Use

  • you shall not misuse the weflip website, the Services or any webpage, server, computer or database connected to the weflip website or the Services including by seeking to gain unauthorised access to the weflip website or the Services or by knowingly introducing malware or other material that is or may be malicious or technologically harmful;
  • you shall not interfere with or disrupt or otherwise attempt to interfere with or disrupt any of the features or functionality of the weflip website, the Services or any webpage, server, computer or database connected to the weflip website or the Services;
  • you shall not gather, extract, download and/or reproduce any material from the weflip website, the Services or any webpage, server, computer or database connected to the weflip website or the Services including (but without limitation) by the use of spiders, data mining, trawling or other 'screen scraping' software or system;
  • you shall abide by any and all limitations on access and your use of the weflip website, the Services or any webpage, server, computer or database connected to the weflip website or the Services imposed by or on behalf of weflip from time to time;
  • you shall not impersonate any person or entity or misrepresent your association with any person or entity or provide data relating to any person or entity without that person's or entity's consent;
  • you shall ensure that any and all content, information, material and/or data which you make publicly available on or through the weflip website does not infringe the rights, including the intellectual property rights, of any third party;
  • you shall ensure that any and all content, information, material and/or data which you make publicly available on or through the weflip website does not contain any offensive, inappropriate or harmful content;
  • you shall not use the weflip website, the Services or any webpage, server, computer or database connected to the weflip website or the Services in any way which shall or shall be reasonably likely to damage weflip's goodwill or reputation; and
  • you shall not use the weflip website, the Services or any webpage, server, computer or database connected to the weflip website or the Services in any unlawful or fraudulent manner or in any way except for your own personal, non-commercial purposes.

11. Availability

weflip aims to provide uninterrupted access to the weflip website and the Services but it will be necessary for essential and scheduled maintenance to be carried out from time to time. weflip does not therefore warrant or represent that the weflip website will be available at all times. Moreover, weflip reserves the rights to terminate, suspend or otherwise limit your access to the weflip website and/or the Services in its sole discretion and at any time.

12. Third party websites

Any and all links to third party websites on the weflip website, or in weflip's communications with you, are provided solely for your convenience and interest. weflip is not responsible for the content of any third party websites and does not verify the accuracy or reliability of any information published on any third party websites. In particular, weflip does not endorse any product or service or promote any opinion, view or advice provided on any such third party websites.

13. Indemnity

You will indemnify, defend and hold weflip harmless against any and all claims, damages, losses, liabilities, actions, judgments, costs and expenses suffered or incurred by weflip arising out of or in connection with your breach of these terms and conditions.

14. Limitation of Liability

Nothing in these terms and conditions shall exclude or limit weflip's liability for fraud or for death or personal injury caused by weflip's negligence. Subject to the foregoing, weflip does not accept any liability for any losses or damages you may incur:

  • if any content, information, material and/or data provided by you or confirmed by you on the weflip website or in connection with your use of the Services is incorrect, incomplete, inaccurate or in any way misleading;
  • in the event that you flip to a provider and/or product or service which does not meet your requirements or is unsuitable for your needs;
  • in the event that a flip request fails or your projected savings prove to be inaccurate because of a change in your circumstances or factors outside weflip's reasonable control;
  • in connection with the terms and conditions applying to any contract entered into by you with a third party (including, but without limitation, any exit, cancellation or early termination charges which you may incur as a result of a flip);
  • as a result of any acts, omissions, errors or defaults of any third party (including, but without limitation, any third party provider to whom you have flipped);
  • arising from your inability to access the weflip website and/or the Services, from any of your use of the weflip website and/or the Services (including, but without limitation, any damage caused by a distributed denial-of-service attack, any malware or other malicious or technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material) or from your reliance on any data transmitted in connection with or arising out of your use of the weflip website and/or the Services; or
  • arising from your use of any linked third party websites or from your reliance on any content, information, material and/or data published on such third party websites.

15. Complaints

weflip strives to provide an excellent level service. If you are unhappy with any aspect of the weflip website and/or the Services please contact our customer services team by post, telephone or email at the details provided in the "how to contact weflip" section of these terms and conditions.

If you are unhappy with any product or service provided by a third party then you should address your complaint to that third party directly. Details of how you may contact that third party should be available on that third party's own website or in that third party’s own terms and conditions.

16. Legal

If any provision or part-provision of these terms and conditions is or becomes invalid, illegal or unenforceable, that provision or part-provision shall be deemed deleted without affecting the validity or enforceability of the rest of these terms and conditions.

These terms of conditions, their subject matter and formation any claims and disputes arising therefrom shall be governed by and interpreted in accordance with the laws of England and Wales.
